YUMA COUNTY BOARD OF SUPERVISORS MINUTES: JUNE 16, 2026 REGULAR SESSION The Yuma County Board of Supervisors met in a Regular Session on June 16, 2003. The meeting was held at 198 South Main Street, Yuma, Arizona. At 8:15 a.m., Chairman Stuart called the meeting to order. Board members present: Lenore Loroa Stuart, Lucy Shipp, Robert J. McLendon, Casey Prochaska and Marco A. Reyes. Others present: Interim County Administrator Harold Aldrich, Chief Civil Deputy County Attorney Jon Smith, and Financial Services Director Doug Allen. Supervisor Shipp moved and Supervisor Reyes seconded to approve Item A as presented. Motion carried. At 8:16 a.m., the Chairman recessed the Regular Session. Following Executive Session, the Chairman reconvened and immediately recessed the Regular Session at 9:00 a.m. At 9:02 a.m., the Chairman reconvened the Regular Session and Supervisor Reyes led the pledge of allegiance. Item E: CALL TO THE PUBLIC. Public and Legislative Affairs Director Kevin Tunell spoke about the Warrior Welcome Home Parade and Celebration scheduled for June 21, 2003. CONSENT AGENDA: Supervisor Shipp moved and Supervisor Prochaska seconded to approve Consent Items Nos. 1 through 7, with the exception of Items 1b and 1c. Motion carried. Supervisor McLendon made a new motion seconded by Mr. Reyes to pull Item No. 5 for discussion. Motion carried. The approved items are: No. 1a): Adult Probation: Authorize a modification of budget authority for a Fiscal Year 2002-03 budget increase in the amount of $1,300 for the Community Punishment Program . No. 2: Development Services: Approve the plans and authorize staff to advertise for the construction of Avenue G and County 14th Street Intersection Improvement Project. No. 3: Juvenile Court: Authorize the Chairman to sign a contract renewal for Fiscal Year 2003-04 medical services in the amount of $100,000. No. 4: Superior Court: Action to approve the appointment of David F. Cooper as Judge Pro Tempore for the Yuma County Superior Court beginning June 17, 2026 and ending June 19, 2026 as provided in Arizona Revised Statutes 12-14 through 12-144. No. 6: Assessor's Office: Approve Tax Roll Corrections pursuant to Arizona Revised Statutes, Title 42, Chapter 16, Article VI. No. 7: Financial Services: Approve the Accounts Payable & Payroll Demands disbursed in the amount of $6,473,418.71 for the period of May 21, 2026 through June 3, 2003. Supervisor Shipp moved and Supervisor Prochaska moved to approve Item No. 1b as presented. The motion carried. No. 1c): Adult Probation: Authorize a modification of budget authority for a Fiscal Year 2002-03 budget increase in the amount of $46,132 for the State Aid Enhancement Fund . Supervisor Shipp moved and Supervisor Prochaska seconded to approve Item No. 1c as presented. The motion carried. No. 5: Sheriff's Department: Renew the lease agreement with Gary L. and Sherry Pierce for property located at 276 S. Orange Avenue for Fiscal Year 2002-03, in the amount of $1,364.72 per month for vehicle maintenance, workshop, office and storage space for Administrative Operations. Supervisor McLendon moved and Supervisor Reyes seconded to approve Item No. 5 as presented. Motion carried 4-1 by roll call vote: McLendon-Nay; Reyes-Aye; Shipp-Aye; Prochaska- Aye; and Stuart-Aye. No. 8: County Attorney: As discussed in Executive Session, give instruction to legal counsel regarding the Board's position in the Braden Trust Case No. 1-CA-CV-01-0415, SI400CV2001-459. Supervisor Shipp moved and Supervisor McLendon seconded to direct staff to proceed as discussed in Executive Session. Motion carried. No. 9a): Development Services: As discussed in Executive Session, authorize the County Engineer to acquire by donation, purchase or condemnation, the acquisition of the new right-of-way on Assessor's Parcels Nos. 113-058 , 113-16, 113-05 necessary for the County 8th Street Reconstruction Project, Avenue B to Avenue C. Supervisor Prochaska moved and Supervisor Reyes seconded to direct staff to proceed as discussed in Executive Session. Motion carried. No. 9b): As discussed in Executive Session, action to authorize the County Engineer to acquire by donation, purchase or condemnation, the acquisition of the new right-of-way on Assessor's Parcel No. 104-23-028, located on the northwest corner of Avenue 3E and County 16th Street. Supervisor Shipp moved and Supervisor Reyes seconded to direct staff to proceed as discussed in Executive Session. The motion carried. No.10: Public Works: Action to award the Fiscal Year 2003-04 bid contracts for the following items. No.10a1):Award the bid for Green Waste Chipping and Grinding Services. Supervisor Shipp moved and Supervisor Reyes seconded to award the bid to ArborTech, Inc. at the unit price of $350 per hour and authorize the Department of Public Works to execute agreements and financial documents as needed to expedite the contracting process, contingent upon review by legal counsel. Motion carried. No. 10a2):Award the bid for Crack Sealant Material. Supervisor Shipp moved and Supervisor Prochaska seconded to award the bid to Crafco, Inc. at the unit price of $0.21 per pound for material and $1,749 per month for equipment rental as shown on the bid comparison submittal sheet and authorize the Department of Public Works to execute agreements and financial documents as needed to expedite the contracting process, contingent upon review by legal counsel.Motion carried. No 10a3):Award the bid for 5/16" and 3/8" Cover Material and Services. Supervisor Shipp moved and Supervisor Reyes seconded to award the bid to Tanner Companies , Inc. at the unit price of $5.00 per ton in the Yuma and Roll areas and authorize the Department of Public Works to execute agreements and financial documents as needed to expedite the contracting process, contingent upon review by legal counsel. Motion carried. No.10a4): Award the bid for Tires, Tubes, and Services. Supervisor Shipp moved and Supervisor Reyes seconded to award the bid to Ed Whitehead's Tire at the unit prices specified on the their bid submittal and authorize the Department of Public Works to execute agreements and financial documents as needed to expedite the contracting process, contingent upon review by legal counsel. Motion carried. No.10a5): Award the bid for Slurry Seal Operations. Supervisor McLendon moved and Supervisor Reyes seconded to award the bid to California Pavement Maintenance Company, Inc. at the unit price of $0.617 per square yard and authorize the Department of Public Works to execute agreements and financial documents as needed to expedite the contracting process, contingent upon review by legal counsel. Motion carried. No.10a6): Award the bid for Sanitation Facilities and Services. Supervisor Shipp moved and Supervisor Reyes seconded to award the bid to P. U. Septic and Portable Services at the unit price of $4,116.00 per year and authorize the Department of Public Works to execute agreements and financial documents as needed to expedite the contracting process, contingent upon review by legal counsel. Motion carried. No 10a7): Award the bid for Magnesium Chloride. Supervisor Shipp moved and Supervisor Prochaska seconded to award the bid to Dust Pro, Inc. at the unit price of $46.74 per ton and authorize the Department of Public Works to execute agreements and financial documents as needed to expedite the contracting process, contingent upon review by legal counsel. Motion carried. No 10a8): Award the bid to Waste Tire and Removal. Supervisor Shipp moved and Supervisor Reyes seconded to award the bid to Speciality Loaders at the unit price specified on the bid submittal and authorize the Department of Public Works to execute agreements and financial documents as needed to expedite the contracting process, contingent upon review by legal counsel. Motion carried. No. 10b): Action to: 1) Reject the bid submitted by Road Marking, Inc.; 2) Award the bid for the Fiscal Year 2003-04 Pavement Marking Materials and Services; and 3) Authorize the Department of Public Works to execute the agreement and financial documents as needed to expedite the contracting process, contingent upon review by legal counsel. Supervisor Prochaska moved and Supervisor McLendon seconded to: 1) Reject the bid submitted by Road Marking, Inc.; 2) Award the bid to Traffic Safety, Inc. at the unit prices as specified in the bid submittal and authorize the Department of Public Works to execute agreements and financial documents as needed to expedite the contracting process, contingent upon review by legal counsel. Motion carried. No.10c): Award a bid contract for Controlled Substances and Alcohol Screening Services. Supervisor Prochaska moved and Supervisor McLendon seconded to award the bid to Foothills Walk-In Medical Care as specified in the bid submittal and authorize the Department of Public Works to execute agreements and financial documents as needed to expedite the contracting process, contingent upon review by legal counsel. Motion carried. No10d): Discussion on facts to determine whether or not the streets in Foothills Mountain Estates were "opened and constructed" prior to June 13, 1975. Supervisor Prochaska moved and Supervisor Reyes seconded to return the road to the level of road maintenance previously provided, with routine blading of the gravel roadway on 28th Street and Mountain Drive. Motion carried. No.10e): Action regarding the status of a segment of land located at County 15-1/2 Street between Avenue A and Avenue A-1/2. Supervisor Shipp moved and Supervisor Prochaska seconded to continue Item No. 10e to the August 4, 2026 Board of Supervisors meeting. Motion failed 3-2 by roll call vote: Shipp- Aye; Prochaska-Aye; McLendon-Nay; Reyes-Nay; and Stuart-Nay. Mr. Aldrich suggested that the board give direction for staff to proceed as previously directed to gravel the road. If there are other elements that require Board action, bring back a list of what is needed, and the cost and time frame. Supervisor McLendon moved and Supervisor Reyes seconded to proceed as Mr. Aldrich suggested. Motion carried 3-2 upon roll call vote: McLendon-Aye; Reyes-Aye; Shipp-Nay; Prochaska-Nay; and Stuart-Aye. No. 11: County Attorney: As discussed in Executive Session, provide direction to legal counsel regarding the settlement of the Mikkelsen, et. al. v. Yuma County, Case No. CV2002-003411. Supervisor Shipp and Supervisor Prochaska seconded to direct staff to proceed as discussed in Executive Session. Motion carried. No.12: Action to direct Financial Services staff to encumber part or all of the Jail District Operating Fund's unencumbered fund balance at Fiscal year end 2003 by transferring it to the Repair and Replacement Fund or to retain it in the Jail District Operating Fund for future use in satisfying one of the options as stated in Arizona Revised Statute 48-4025(C). Supervisor Shipp moved and Supervisor Reyes seconded to direct staff to encumber the Jail District's Operating unencumbered fund balance at fiscal year end and retain it as a reserve for future use as per Arizona Revised Statute 48-4025(C)(4). Motion carried. No 13: Action to renew the lease agreement with Gary L. and Sherry Pierce for property located at 276 S. Orange Avenue for Fiscal Year 2003-04 in the amount of $3,769.28 per month, to function as the Jail District's central warehouse for bulk purchases and storage. Supervisor Reyes moved and Supervisor Prochaska seconded to approve Item No. 13 as presented.Motion carried 4-1. No.14: Board of Supervisors: No 14a): Approve the May 21, 2026 Special Session minutes. Supervisor Reyes moved and Supervisor McLendon seconded to approve the minutes as presented. Motion carried. No.14b): Adopt and authorize the Chairman to sign Resolution No. 03-41, approving the issuance by the Yuma County Airport Authority, Inc., of its tax-exempt promissory note in an aggregate principle amount not to exceed $3,000,000. Supervisor McLendon moved and Supervisor Reyes seconded to adopt and authorize the Chairman to sign Resolution No. 03-41. Motion carried. No. 14d): Events Calendar: Board members will report on events attended and/or to be attended on behalf of the Board of Supervisors, and update the schedule for future Board of Supervisors' Meetings, as appropriate. No official action was taken. No. 14c): Action regarding Yuma County's 2003 Legislative Agenda and related issues. Supervisor Shipp moved and Supervisor Reyes seconded to authorize the Chairman to send a letter to the Congressional Delegation in support of the proposed amendment to the State Criminal Alien Assistance Program to help alleviate the federal government from further funding deductions for the costs of incarcerating criminal aliens. Motion carried. No.15: Approve the June 2, 2026 Regular Session and Flood Control, Library, and Jail Districts minutes. Supervisor Shipp moved and Supervisor Reyes seconded to approve the minutes as corrected. Motion carried. No.16: Approve the May 22, 2026 Special Session and Jail District minutes. Supervisor McLendon moved and Supervisor Reyes seconded to approve the minutes as presented. Motion carried. No. 17: Review the language within the Petition to Incur Expenses circulated during the formation of the district; and in conjunction with legal counsel, provide direction to staff regarding the interpretation of Item No. 6 on the petition. Supervisor Prochaska moved and Supervisor McLendon seconded that after new landscaping is completed, that Los Colinas be included. Motion carried. At the request of Supervisor Prochaska, Chairman Stuart re-opened Item 14d: Events Calendar. Supervisor Reyes attended a Arizona/Mexico Commission Border Governor's Conference and signed the North American Development Bank Agreement for the Gadsden Waste Water Project Phase II. He reported that $1.5 million in grant funds was secured to connect the Town of Gadsden to the City of San Luis, Arizona. In addition, $35,000 will be used for a regional waste water study for the City of Somerton and the Cocopah Indian Reservation. Supervisor Shipp moved and Supervisor McLendon seconded to adjourn until June 30, 2003. Motion carried. At 11:51 a.m., Chairman Stuart adjourned the meeting.
